Alabama Alimony Laws and Spousal Support
During the pendency of a divorce action, an Alabama Court may make an award of spousal support, or alimony, for the benefit of either spouse. This is known as "temporary" support. A Alabama Court may also make a permanent order of support or alimony for either spouse if it is shown that the spouse who is requesting support either does not have sufficient property to provide from his or her own support. The factors to be considered are:
(2) the condition of the spouse's family.
Marital fault, or misconduct may be considered by the Court in determining alimony or spousal support and, in proper cases, may bar a party�s right to receive support. Once permanent support has been ordered, payments will end upon proof that the party receiving the spousal support is living openly with a member of the opposite sex or has remarried.
